Introduction

IP Attorneys have IP expertise, strategic problem-solving skills, reliable judgment, excellent written and oral communications skills, and comfort engaging with clients and outside counsel. The individual has demonstrated the ability to consistently engage in teamwork, cross-functional collaboration, and be a positive opinion leader in a dynamic environment. 

 The successful candidate will provide counseling to business groups on a wide variety of intellectual property-related opportunities and risks, emphasizing a pragmatic, business-oriented approach to problem-solving. This position will provide guidance as a trusted advisor to internal clients on a variety of IP-centric agreements and issues including those related to secrecy, development, and licensing. The successful candidate will apply judgment to advise on ways to effectively manage risk on various IP-related clauses in service and procurement agreements. Management of and collaboration with outside counsel to efficiently manage all aspects of out-sourced IP work is an important aspect of this position. This position will include supervisory responsibilities. 

Responsibilities

  • Serve as primary legal support to selected technology lines and support stakeholders on general IP matters

  • Oversee patent committee meetings and manage all aspects of the preparation and prosecution of patent applications to develop the company’s domestic and foreign patent strategy

  • Assist with defensive and offensive EP oppositions

  • Advise and counsel clients on matters related to intellectual property issues including patents, trademarks, copyrights, and trade secrets

  • Analyze and assess third-party patents and patent applications for potential risk

  • Conduct training for employees on all aspects of intellectual property

  • Act as a trusted advisor on IP-related issues in agreements with IP related issues such as university agreements, non-disclosure agreements, services agreements, product agreements, or others.

  • Manage Trademark portfolio including trademark oppositions and brand enforcement

  • Manage a team of patent liaisons, paralegals, legal assistants, or combination.

  • Keep up to date on new patent law related rulings at Appeals and Supreme Court level

    Required Qualifications

  • Law degree from a nationally accredited law school

  • Admission to practice before a U.S. state bar, preferably Texas (Note: Admission to State Bar of Texas will be required in any event after reasonable period of time)

  • Admission to practice before the U.S. Patent & Trademark Office

  • At least 5 years of experience in a corporate legal department or in private practice with relevant intellectual property experience

  • Highly effective at distilling and explaining complex intellectual property issues to personnel at a variety of levels within the organization

    Preferred Qualifications

  • BS Degree Chemistry, Chemical Engineering, or similar field

  • Experience overseeing development and maintenance of domestic and foreign patent portfolios through drafting and prosecution of patents

  • Experience in trademark counseling and prosecution

  • Managerial experience

  • Knowledge of privacy law

  • Experience in IP litigation
