State of Utah - Jobs Administrative Law Judge in SALT LAKE CITY, Utah

Are you an experienced attorney looking for an impactful position that allows for work life balance? The Department of Commerce needs to fill an Administrative Law Judge position. 

 

**After an in-office training period,this is a hybrid remote position that allows for 3-4 days of telework,if eligibility requirements are met. 

 

PRINCIPAL DUTIES

As the Administrative Law Judge you will preside over formal and informal administrative proceedings brought on behalf of the Department of Commerce. The subject matter of cases ranges from securities to real estate,medical licensing,and consumer protection. You will see cases involving allegations of deception,statutory violations,or professional misconduct by licensees or businesses. Your duties will include,but not be limited to the following: 

  • Ruling on evidentiary issues and pre-trial motions. 
  • Conducting pre-hearing conferences. 
  • Issuing subpoenas.  
  • Conducting hearings (which may include written and/or oral testimony and cross-examination). 
  • Maintaining an organized hearing calendar. 
  • Reviewing briefs. 
  • Preparing and issuing written findings of fact and conclusions of law.
  • Conducting,or representing agency at,formal or informal hearings.
  • Ruling on the admissibility of evidence,evaluating evidence and making decisions on cases.
  • Explaining differences between hearing and civil procedures to litigants,attorneys and others. Resolving procedural issues such as requests for continuances.
  • Establishing witness lists,holding pre-hearing conferences,selecting and utilizing subject matter experts.
  • Making final judgment with responsibility for decisions,including defending decisions in any legal proceedings.
  • Questioning witnesses and considering testimony and evidence that is presented.
  • Issuing written orders,making rulings and/or adjudicating administrative cases.
  • Providing consultation,making recommendations,giving appropriate advice,and/or facilitating decisions.

IDEAL CANDIDATE

Our model candidate will have: 

  • Ethical integrity. 
  • A self-starter attitude and the ability to operate independently. 
  • Clear communication skills,both verbally and in writing. 
  • Experience applying the law to the facts of the case,and issuing legally sufficient decisions in a timely manner.
  • The ability to be neutral/impartial,open-minded,and courteous with parties.
  • Exceptional writing and case management skills.

     

PREFERENCES

Preference will be given to applicants with at least five years of experience as a practicing attorney,and significant experience in the following areas:

  • Litigation experience or experience representing a government agency. 
  • Administrative hearings.
  • Utah Administrative Procedures Act (UAPA) and administrative rules.

  • Retirement - Utah Retirement Systems (URS):
    • Employees who have any service credit with an employer covered by the Utah Retirement Systems prior to 7/1/2011 are in the Tier I Public Employees System.
    • Employees hired on or after 7/1/2011 and who have never been in the URS retirement system have two options for retirement in the Tier II System. 
      • Tier 2 Hybrid Retirement System. Employer contributes an amount equal to 10% of your salary between both plans (pension and 401(k))
      • Tier 2 Defined Contribution Plan. Employer contributes an amount equal to 10% of your salary to a 401(k) plan only.  
    • Employer contributions to your 401(k) are vested after four years.
  • Paid Time Off:
    • Annual leave and sick leave are accrued at 4 hours per pay period each (4 hours annual,4 hours sick).
    • Annual leave amounts increase with years of service. 
    • We have 12 paid holidays.
