Duties Description This position is under the general supervision of the Agency Counsel. This position is an entry-level position and expected to provide general legal assistance and support to current Agency staff. Specific duties for this position may include but are not limited to:• Drafting or reviewing legal documents, regulatory and legislative proposals, litigation documents, contracts, and other documents related to the Agency’s regulatory, enforcement, state land, and government services work as well as the agency’s general administration.• Assisting or coordinating with other government agencies or offices, including the Attorney General’s Office, relating to the Agency’s litigation, regulatory, enforcement, state land, and government services work.• Representing and supporting APA staff in meetings in support of APA’s regulatory, enforcement, state land, and local government services programs.• Representing APA staff in adjudicatory hearings and other proceedings on permitting, state land, and enforcement matters, including but not limited to the preparation of legal documents, preparing and examining witnesses, and conducting cross-examinations. • Developing a thorough knowledge of the APA, Wetlands, and Rivers Acts and implementing regulations and case law, and a working knowledge of other statutory and regulatory requirements, including FOIL, SAPA, POL, ECL, SEQR, Town Law, and Executive Orders relevant to administration of the APA. Minimum Qualifications NY HELPS Open-Competitive Qualifications: Senior Attorney: Admission to the NYS bar and two years of post-licensure professional legal experience.Assistant Attorney 3: One year as Assistant Attorney 2 or admission to the NYS Bar and one year of subsequent professional legal experience.Assistant Attorney 2: Admission to NYS BarAssistant Attorney 1: Law School Graduation (or other eligibility to take the NYS Bar Examination)Salary:This position requires the completion of a traineeship leading to Senior Attorney, SG-25; the length of the traineeship will be determined by the credentials and experience possessed by a candidate. The starting salary for each traineeship level can be found below:• Assistant Attorney 1, NS = Grade 18 - $65,001/ year, the hiring rate for PEF salary grade (SG-18)• Assistant Attorney 2, NS = Grade 20 - $72,032/ year, the hiring rate for PEF salary grade (SG-20)• Assistant Attorney 3, NS = Grade 22 - $79,928/ year, the hiring rate for PEF salary grade (SG-22)Completion of the traineeship will result in permanent advancement to the Senior Attorney, SG-25 - starting salary of $93,530 - without further examination. Candidates may be eligible for appointment directly to the Assistant Attorney 2, Assistant Attorney 3, or Senior Attorney level, depending on qualifications. Alternate Minimum Qualifications:The candidate may also be eligible for appointment to this position if they meet any of the following minimum qualifications.52.6 Transfer Qualifications to Senior Attorney, G-25: Applicants may be appointed to this position permanently if they have: one year of permanent, competitive service in a title designated as appropriate for transfer under Section 52.6 of the Civil Service Law.70.1 Transfer Qualifications to Senior Attorney, G-25: Applicants may be appointed to this position permanently if they have: one year of permanent, competitive service in a title designated as appropriate for transfer under Section 70.1 of the Civil Service Law. 55-b/c Qualifications: Applicants may be appointed to this position permanently if they meet these qualifications: you must be a graduate of an accredited law school with an LLB or JD degree.Information about the Workers with Disabilities 55-b and the Veterans with Disabilities employment program 55-c can be found at 55b/c Recruitment Resources Center (ny.gov).Note: Non-competitive refers to not competing in an examination; the appointment will be competitive.For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts. This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, which mean no examination is required but all candidates must meet the minimum qualifications for the title for which they apply. At this time, agencies may recruit and hire employees by making temporary appointments. In June 2024, if a temporary NY HELPS employee is satisfactorily performing in the position, the appointment will be changed from temporary pending Civil Service Commission Action to permanent non-competitive and the official probationary period will begin.At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified. To be considered for appointment through NY HELPS, or 55b/c, candidates must meet the open-competitive minimum qualifications for this position.
