Joining us means joining a caring, responsible, and innovative company where more than 70,000 people lead the way to greener and smarter mobility, worldwide The Project Contract Manager (PrCM) is a key is a key member of the project team, working in close collaboration with the Project Manager and will be responsible for leading the Project Core Team in the management of commercial, contractual and claim aspects of the project for all Customer, Consortium/JV partner and supplier Contract(s). He/she provides guidance and leadership to develop and implement proactive contract/claim management and risk mitigation strategies in accordance with Alstom's business objectives and policies. He/she will lead/support development of extensions of time (EoTs), variations orders, contract amendments, as well as ensure proper record keeping and file preparation in support of robust claim files. PrCM must bring a pragmatic commercial and contractual approach and strategy based on an analysis of the project and contractual obligations, to protect Alstom interests, and to improve the project's scope delivery, schedule, revenues, cash and margin through effective management of the contract and implementation of any variation order and change management processes. Key accountabilities Ensures application of Contract, Claims and Insurance Management Manual (CCIM) and Alstom governance. Prepares Contract Summary and ensure it is widely communicated and regularly updated. Prepares, with Project Core Team, Contract Management Strategy Plan (CMSP) and informs the project team members on specific contractual points during Contract Management Day Carefully analyzes the contract to build and drive implementation of Contract/Claim Management Strategy Plan, as well as keep it updated and communicated with project team on a quarterly basis. Contributes to other Project Team members documents as required (e.g. CDRLs, correspondence, meeting presentations) so that these are launched in time, accurately communicated, and regularlly updated. Monitors Project Scope of Works, Schedule and Milestones against the contract obligations. Ensures timely issuance of contractual notices. Establishes and implement project specific commercial procedures, particularly regarding correspondences, notifications, insurance, variation requests/orders and claims preparation. In collaboration with Documentation Controller and/or Project Contract Administrator, ensures a reliable filing and access for all project correspondences and records. Monitors/manages incoming and outgoing correspondence (for and with Project Manager/Director). Contributes to Return of Experience (REX). Monitors/manages insurance policies and their validity in collaboration with Regional Insurance Manager. Supports the Regional Insurance Manager in updating for all changes/deviation to insurance policies. Develops and produces any project specific processes and ways of working for contract/claim management. Carefully monitors, records, and notifies customer/partners and any third party regarding claims/counterclaims and prepares/manages all elements and supporting documentation for claims/counterclaims negotiations. Monitors customer/partner requests for variations / change orders / extensions of time. Provides follow-up, as necessary, to drive transactional closure, including updating VO/VR/Delay registers, preparation of commercial offer, and prepares contractual letters for CD/PM/PD approval. Provides proactive advice on specific issues, risks, contractual/claims activities, in accordance with the contract and business objectives. Reports on project progress, specifically for contract management and claims activities to the Legal, and Contract Management and other Alstom business functions (e.g. Senior/Executive Management, Finance). Ensures Contract management KPIs are reported as per reporting deadlines Provides training on contract/claim management to key project stakeholders, including project management, finance, engineering, sourcing and suppliers. Anticipates events and risks associated with project management activities; propose alternative proactive solutions to ensure project situation remain under control and in accordance with contract. obligations Works closely with the Project Directors, Project Managers, Project Controllers, Project Engineering Managers, Key Supplier Contract Managers, and Project Planning Managers, to identify and mitigate risks; and to identify and maximize opportunities. Provides at any time, on management demand, a reliable and understandable contractual and commercial analysis of the project. For any Dispute Arbitration Board (DAB) or similar non-litigation mechanism for dispute resolution, PrCM is required to prepare files, referral notes along with substantial evidences and participate in the process for dispute resolution. For litigation process handled by Legal Team, PrCM will support the Legal Team and/or external counsel Must be able to travel sporadically as required - generally up to 20% to 30% of the time. Education and Qualification A degree in Law, Engineering, Finance, Technical, Economics or business sciences Qualification and extensive commercial / operational experience, including Post-graduate commercial, business and related qualifications are well regarded. Minimum 4-6 years of experience in relevant role Competencies & Skills Ability to read and interpret contractual documents, including terms and conditions, planning, and technical specifications Ability to write routine reports and correspondence. Ability to speak effectively before groups of customers or employees of organization. Ability to understand project financials and impact of contract/claim management on project's profitability. Ability to solve practical problems and deal with a variety of variables in situations. Ability to interpret a variety of instructions furnished in writing, oral, diagram, or schedule form. Ability to anticipate and manage conflicting priorities. To perform this job successfully, an individual should have knowledge of Contract Management systems; Project Management software; Excel Spreadsheet software and Microsoft Office Word Processing software. Ability to work in a proactive mode Ability to work transversally and collaboratively in a strong spirit of teamwork.
