New York State Department of Motor Vehicles Administrative Law Judge/Assistant Administrative Law Judge in NEW YORK, New York

The Administrative Law Judge, under the title of Motor Vehicle Referee, will be engaged in professional legal work conducting administrative hearings and rendering decisions for the adjudication of moving traffic violations, as well as those involving fatal accidents, persistent violators, false statements on Motor Vehicle documents, or driving without insurance. They will also conduct hearings involving charges of violations of the Vehicle and Traffic Law and the Commissioners Rules and Regulations by commercial establishments such as repair shops, dealers, inspection stations, driving schools, commercial bus drivers and school bus operators. In some cases, the incumbent will prepare cases for review by the Motor Vehicles Appeals Board. In addition to the New York Vehicle and Traffic Laws and Commissioners Rules and Regulations, the incumbent of this position will also render decisions for violations of the Navigation Law by boaters, and the Parks, Recreation and Historic Preservation Laws by operators of snowmobiles. Decisions are also influenced by the Zero Tolerance Program as well as new regulations concerning emission inspections.Minimum Qualifications:Assistant Administrative Law Judge (Assistant Motor Vehicle Referee/Assistant Motor Vehicle Referee Spanish Language) (equated to SG-22): 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency.Administrative Law Judge (Motor Vehicle Referee) (SG25): Admission to the NYS bar and two years of post-licensure professional legal experience.The preferred candidate should be a highly motivated individual interested in working in public service as part of an active legal team with at least three years experience as a New York State Attorney.
