Purpose of Role

The Associate Counsel will provide trademark, copyright, and product compliance support to business units in accordance with his/her responsibilities. The Associate Counsel will help manage Under Armour’s APAC trademark and copyright portfolios, enforce against unauthorized third-party uses of UA intellectual property, and will advise the business on China-specific marketing and product compliance requirements.

Your Impact

  • Review advertising copy and promotional materials across all forms of media. Conduct risk assessments and advise business on local claim substantiation requirements.

  • Coordinate requested localization of marketing claims to include additional information. Assist with translation accuracy.

  • Communicate regularly with global counsel and regional Quality Assurance team to understand the context of product functions, testing methods, and processes. Advocate on behalf of Under Armour when local quality supervision authority conducts market tests/audits, and appeal any adverse results to the relevant authorities and their designated testing institution.

  • Structure and review Terms and Conditions for marketing promotions, including Asia-Pacific sweepstakes, contests, and other promotions and incentives.

  • Provide support on a broad range of IP matters, including Asia-Pacific trademark, copyright and design clearance, enforcement, transactions, and domains.

  • Conduct Asia-Pacific clearance searches to determine availability of proposed trademarks, taglines, product names, product designs and other consumer-facing content.

  • Manage significant volume of Asia-Pacific trademark prosecution and enforcement matters with Intellectual Property offices as well as with third parties. Liaise with, and supervise outside law firms, vendors and internal business partners as needed for pending IP matters.

  • Draft legal documents, including cease and desist letters and Notices of Opposition. Contribute to enforcement of UA rights and risk management and mitigation strategy.

  • Work with global IP counsel to prepare trademark authorization letters for Under Armour vendors, partners, and licensees.

  • Coordinate with local anti-counterfeiting team to file takedown notices and complaints to online platforms, so as to remove unauthorized and/or infringing product.

  • Assist with product recalls, investigations, or other challenges from local authorities.

  • Provide education and proactive counseling to the business to manage risk and enhance IP protection.

Qualifications

  • 6+ years of experience in-house or law firm focusing on intellectual property (including trademarks, copyrights, marketing, consumer product)

  • JD/ Qualified lawyer with 6+ post-qualification experiences

  • Admitted in Hong Kong and commonwealth jurisdictions

Base Compensation

Most new hires fall within this range and have the opportunity to earn more over time. Initial placement within the salary range, however, is based on an individual's relevant knowledge, skills and experience for the position.
