The pay range for this position is $37.22 - $51.07 per hour

The State of New Hampshire, Department of Safety, Office of the Commissioner has a full-time vacancy for Hearings Examiner, SOC Title 23-1020 ADMIN LAW JUDGES-6. This position has a 37.5 hour work week and is considered exempt.

SUMMARY:Functions as a member of the Department of Safety, Bureau of Hearings as an agent for the Commissioner and Directors to conduct administrative hearings concerning all areas regulated by the agency. Prepares written opinions including findings of fact, conclusions of law and dispositions and recommends hearings policies and regulations.

18 Months or 1.5 Years of additional relevant experience = Associate's degree

36 Months or 3 Years of additional relevant experience = Bachelor's degree

54 Months or 4.5 Years of additional relevant experience = Master's degree

MINIMUM QUALIFICATIONS:

Education:J.D. from a recognized law school.

Experience:Five years' experience as an attorney, two years of which must have been as an attorney involved with administrative law or concerned with regulatory authorities.

License/Certification:Must possess a valid drivers license.

SPECIAL REQUIREMENTS:

  1. Must be an active member of the New Hampshire Bar Association and in Good Standing.

  2. Selected candidate will undergo a fingerprint-based criminal background check and motor vehicle record check in order to ensure suitability for exposure to confidential information.

Temporary downgrade minimum qualifications for applicants lacking this requirement and/or the minimum qualifications as listed above:

HEARINGS EXAMINER, Salary Grade 28:

Education:J.D. from a recognized law school.

Experience:Three years of post-graduate experience in the practice of law, preferably involved with administrative law and/or regulatory authorities.

HEARINGS EXAMINER, Salary Grade 26:

Education:J.D. from a recognized law school.

Experience:Six months of experience as a law clerk, preferably involved with administrative law.

RECOMMENDED WORK TRAITS:Knowledge of state statutes and regulations pertaining to the Department of Safety. Knowledge of training and supervisory techniques. Knowledge of courtroom procedures and rules. Ability to conduct complex hearings for the agency. Ability to instruct, direct and evaluate subordinate legal employees. Ability to prepare, draft and present documents, operations and orders of law. Ability to speak and write effectively. Must be willing to maintain appearance appropriate to assigned duties and responsibilities as determined by the agency appointing authority.

RESPONSIBILITIES:

Conducts administrative hearings statewide, rules on motions, weighs relevance of testimony and exhibits and renders administrative decisions based upon testimony and evidence submitted. Issues timely written decisions to include findings of fact, conclusions of law and dispositions.

Conducts pre-hearing conferences to define issues, determine areas of agreement, secure stipulations and accept written and oral motions.

Advises superiors on probable legal impact of proposed changes in civil, criminal and motor vehicle laws impacting the department. Evaluates court decisions to determine impact on matters to come before the Bureau and to determine precedent on legal matters.

Researches legal questions to advise superiors on probable legal impact of proposed changes in New Hampshire rules and state and federal regulations.

Reviews files and records to ascertain if all court and administrative requirements for licenses, certificates, permits, registrations, and operating privileges have been met.

Approves records authorizing restoration of licenses, operating privileges, registrations, certificates, permits, and dealer and inspection privileges.

Explains complex policies, rules, and statutes to inquiring parties, law enforcement agencies, attorneys and members of the public in order to educate on best practices in an arrest and to answer questions.

Handles cases appealed to Superior Court and administrative hearings before other state boards, as needed, to assure timely disposition.

Testifies in Superior and Circuit Courts statewide on behalf of the Department as keeper of the records.
