Work Schedule: 8 Hr (8:00:00 AM - 5:00:00 PM)

Under the direct supervision of the Senior Associate General Counsel - Regulatory & Transactions of Rush Legal or his/her designee, the individual selected for this position will provide legal advice and counsel on healthcare transactions, compliance and regulatory matters, and various special projects. The Assistant General Counsel will assist in RUMC¡¦s legal analysis and compliance with state and federal non-profit, charitable organization, and tax-exempt status. The individual must exemplify the Rush mission, vision and values and act in accordance with Rush policies and procedures.

Responsibilities:

  • Regulatory: Provide counsel regarding federal and state laws relating to healthcare, including, but not limited to, Medicare and Medicaid program reimbursement and coverage matters, fraud and abuse counseling (including the Anti-Kickback and Stark Laws), HIPAA, False Claims Act, laws relating to tax-exempt organizations, Joint Commission standards, compliance program implementation and oversight, and state licensing and regulatory matters

  • Corporate: Provide legal review, drafting and approval of agreements on behalf of Rush and its affiliated entities relating to various healthcare arrangements including, but not limited to: PSAs, Management Agreements, Physician Contracts, operating agreements, Business Associate Agreements, Data Registry and Collaborative Research.

  • Provide legal opinions regarding Stark transactional review, processes and documentation on unwritten transactions and current contracts.

  • Identify applicable Stark exception for financial relationships between RUMC and physicians to determine and reform legal sufficiency of contracts as necessary.

  • Identify and coordinate an analysis of contracting components of Rush University Medical Center by examining joint ventures, affiliations, and other institutional financial relationships.

  • Utilizes position to create synergies in compliance process throughout RUMC.

  • Oversees and creates an internal annual legal review process of Compliance policies.

  • Other matters as assigned.

Job Qualifications:

  • Juris Doctor from an ABA accredited College of Law.

  • 3-5 years of experience in a law firm or in-house legal department working with hospitals and/or health systems.

  • Experience with fraud & abuse laws and other similar compliance concerns.

  • Experience handling healthcare transactions.

  • Licensed to practice law in at least one state and in good standing in all states where admitted.

  • Member of the Illinois State bar or eligible to sit for the Illinois State bar.

  • The successful candidate will have superior academic credentials, and excellent, writing, analytical and oral communication skills,

  • Experience in legal research and writing on healthcare law matters; contract review; drafting and negotiating healthcare agreements.

  • Knowledge of key regulatory areas applicable to hospitals and health care systems. Knowledge of Anti-Kickback Statute, Stark Act, False Claims Act and HIPAA is essential.

  • Must be highly organized and able to identify and analyze complex issues and develop creative solutions.

  • Position requires good business judgment, initiative, and ability to work independently and as part of a team.
