Position Summary

The Litigation team is seeking to fill a counsel position responsible for oversight of the eDiscovery team. Collaborating with other attorneys and staff in the Office of General Counsel (OGC), the counsel will ensure discovery legal services support for the business operations of Duke Energy Corporation.

We are looking for a creative, collaborative, results-oriented attorney with a minimum of two years of relevant experience to support the company with its eDiscovery efforts. This role will have a special emphasis on developing defensible processes for preservation, collection, processing, culling, searching and producing electronically stored information; collaborating with Duke Energy attorneys and outside counsel to develop unique, cost-effective strategies for eDiscovery in specific cases; and coordinating with the eDiscovery team on technology implementation. The incumbent will interface with many different individuals internally and external to the Company. The incumbent will work under the supervision of an associate general counsel or deputy general c ounsel.

Responsibilities

  • Assist the Corporate Litigation team with the development and implementation of standard best practices and processes relating to e Discovery

  • Handle all eDiscovery matters as assigned, including managing vendors or outside counsel relationships, as well as setting and monitoring budgets; managing the Company’s responses to subpoenas and administrative requests, as assigned

  • Track legal matter metrics as needed

  • Develop, implement, enhance and update OGC and Corporate Litigation policies, procedures, best practices, and training materials as they relate to e Discovery

  • Lead and/or attend training relating to matter management, eDiscovery, evidence preservation, and litigation best practices

  • Provide testimony or affidavits to support and defend the Company’s eDiscovery processes and procedures in active litigation matters, as necessary

  • Assist with early case assessment for significant matters

  • Develop eDiscovery strategy, including staffing recommendations and objectives, for complex litigation

  • Possess a thorough understanding of Document Requests, ESI Protocols, Protective Orders and Production Orders

  • Oversee all aspects of document and privilege review

  • Participate on cross-functional teams as an investigative and substantive eDiscovery resource

  • Advise and consult with senior management on eDiscovery issues with significant value, or which may have economic, legal, political or regulatory implications for the Company

  • Remain current on legal trends, laws and regulations in the eDiscovery space and proactively communicate pertinent information to other attorneys in the Legal Department

  • Research and monitor case law, federal, state and local rules, and other statutory developments impacting discovery

  • Assist with legal and compliance training for business units within the Company

  • Promote a positive corporate image through involvement in Company and civic affairs

  • Lead and/or serve on committees, special projects, or other assignments as directed to further departmental goals

  • Perform other duties as assigned

Basic/Required Qualifications

  • Doctor of Jurisprudence degree from an accredited law school

  • In addition to degree, two (2) years minimum of related work experience

  • Licensed to practice law in North Carolina or South Carolina, or licensed to practice in any state in the US and eligible for comity

Desired Qualifications

  • At least two years minimum of related work experience, preferably in litigation

  • A thorough understanding of the eDiscovery process

  • Ability to manage eDiscovery projects without intervention by senior attorneys

  • Technically proficient in multiple areas of law with experience in litigation

  • Thorough understanding of Data Preservation and Legal Holds

  • Ability to interpret and enforce Company Information Governance policies, records policies and data sources

  • Strong command of eDiscovery rules, as well as substantial document control and case management experience, including document review and preliminary case assessment

  • Experience and interest in working with litigation tools and technology, including document review tools (Casepoint, Relativity, Exterro) and eDiscovery tracking tools

  • Excellent interpersonal, presentation, communication and writing skills

  • Ability to learn quickly, work independently with minimal supervision, manage and prioritize multiple tasks

  • Experience supporting investigations, litigations, information gathering and other projects in a collaborative team environment

  • Exceptional judgment and decision-making abilities

  • Strong planning, organizational, analytical and problem-solving abilities

  • Detail-oriented, proactive, self-directed and responsive, with extraordinary dedication to client service

  • Organizational agility, with ability to gain the confidence and respect of management and clients

  • Ability to take direction and act accordingly with conviction, in a timely and high -quality manner

  • Ability to function effectively and efficiently in a fast-paced and dynamic environment and to prioritize conflicting demands from multiple business clients

Working Conditions

  • Ability to come into the Charlotte office at least three (3) days a week

  • Hybrid mobility classification - work will be performed from both remote and onsite locations after the onboarding period. However, hybrid employees should live within a reasonable commute to Duke Energy Plaza in Charlotte, NC.
