Job Summary

The City of Baytown is seeking a qualified and motivated individual to join our team as an Assistant City Attorney I/II specializing in Municipal Court matters. This position plays a key role in ensuring the fair and effective administration of justice within the municipal court system. The successful candidate will work under the guidance of the City Attorney and will be responsible for providing legal counsel, representation, and support in matters related to municipal court proceedings.

The Assistant City Attorney I/II prosecutes criminal cases in Municipal Court, represents the City in civil litigation in Municipal Court and other courts as necessary, including, but not limited to, misdemeanor offenses, code enforcement, and substandard structure matters. Provides counsel to employees, officers, and various boards and commissions. Conducts training for various departments. Interfaces with the District Attorney's Office and other local, state, and federal law enforcement agencies. Prepares and/or reviews interlocal agreements, contracts, ordinances, etc. Drafts subpoenas, legal motions and briefs, and conducts legal research as necessary.

Qualification for Criminal Justice Information Services (CJIS) certification, including successfully passing a background and fingerprint check is an essential function of this position.

Duties

  • Prosecutes cases in Municipal Court, including attending, litigating and preparing for various dockets, trials, and hearings. Drafts and litigates various motions, both criminal and civil.

  • Makes suggestions for changes in City ordinances and works with City committees.

  • Interfaces with Police Officers and Code Enforcement Officers on enforcement activities arising under the law.

  • Reviews laws/legal decisions, statutory and judicial, and informs appropriate personnel of any changes. Coordinates court cases and all related information with the City Attorney and Legal Department Staff.

  • Reviews and responds to public information/subpoena requests.

  • Prepares and/or reviews interlocal agreements, contracts, ordinances, etc.

  • Performs all other related duties as assigned.

Minimum Qualifications

Assistant City Attorney I

Required:

  • Juris Doctorate Degree from an accredited Law School.

  • Licensed to practice law in the State of Texas.

  • Valid Texas driver’s license with an acceptable driving record (must obtain TX driver’s license within 90 days).

Preferred:

  • Municipal law experience.

  • Prosecutorial experience at county or district court level.

  • License to practice law in U.S. Court of Appeals-5th Circuit.

  • Experience as a prosecuting attorney in municipal court.

  • Bilingual in English/Spanish.

Assistant City Attorney II

Required:

  • Juris Doctorate Degree from an accredited Law School.

  • Licensed to practice law in the State of Texas.

  • Three years of experience in a Municipal law role or three years of experience in practicing law.

  • Valid Texas driver’s license with an acceptable driving record (must obtain TX driver’s license within 90 days).

Preferred:

  • Prosecutorial experience at county or district court level.

  • License to practice law in U.S. Court of Appeals-5th Circuit.

  • Experience as a prosecuting attorney in municipal court.

  • Bilingual in English/Spanish.

Knowledge, Skills and Abilities

Knowledge of Texas criminal, traffic, rules of evidence, and theories of civil liability and the defenses associated therewith. Knowledge of municipal law, including authority of home rule cities, criminal litigation, civil litigation, jurisdiction and appellate procedure. Knowledge of Open Records Act, Code of Criminal Procedure, court procedures, the Code of Civil Procedure, and federal criminal law. Skilled in oral and written communication, telephone, computer and calculator. Ability to convey and counsel in a manner understandable to non-lawyers, teach in classroom and in the field, and develop a working relationship with staff from various departments. Ability to prepare accurate and precise legal documents. Ability to get along appropriately with co-workers and the public.
