GENERAL DESCRIPTION This Hearings Officer position in the Crime Victim Services Division of the Office of the Attorney General (OAG) performs complex legal and technical work. Work involves conducting administrative hearings and preparing hearings decisions. May provide guidance to others and may prepare and conduct administrative or appeals hearings procedure training. ESSENTIAL POSITION FUNCTIONS Conducts administrative hearings and prepares hearings decisions for the legal section; manages the hearing docket and responds to telephone inquiries regarding appeals. Performs independent investigations as needed, including evaluating evidence and interviewing victims, witnesses, medical professionals, and law enforcement officers in order to conduct hearings and make final determinations based on relevant laws, rules, and policies. Prepares for hearings by researching and reviewing applicable laws, regulations, policies, and legal precedents. Explains the hearing process and issues oaths and affirmations to hearing participants, monitors hearing activities, limits testimony to relevant facts, and ensures that the hearing moves expeditiously. Confers with agency personnel to obtain additional information bearing on hearings. Issues written decisions affirming, modifying, or reversing previous rulings based on testimony, claims records, evidence, applicable provisions of laws, and established precedents. Tracks and/or schedules hearings-related activities to ensure that deadlines are met. Assists in the preparation of legal documents, compiling the administrative record and other tasks related to litigation and judicial or administrative proceedings. Assists in preparation of pre- and post- trial documents and provides assistance in lawsuits arising from dissatisfaction of compensation claim decisions. Assists in composing and editing correspondence, policies, and related administrative materials as needed. Assists in division compliance with the Public Information Act. Performs related work as assigned Maintains relevant knowledge necessary to perform essential job functions Attends work regularly in compliance with agreed-upon work schedule Ensures security and confidentiality of sensitive and/or protected information Complies with all agency policies and procedures, including those pertaining to ethics and integrity Qualifications: MINIMUM QUALIFICATIONS HEARINGS OFFICER III: Education: Graduation from high school or equivalent Education: Graduation from an accredited college or university with a masters degree in public administration, law, or a crime related field; may substitute required education for six years full-time experience in the administrative law arena or legal work, on a year to year basis. Experience: Three years experience working in the following (or closely related) field: victim services law Experience in administrative or appeals procedures, claims, labor and employment, or legal work Knowledge of local, state, and federal laws, rules, and regulations relevant to crime victim matters; hearings proceedings; civil procedure; and administrative and regulatory laws in the State of Texas. Knowledge of legal terminology, research methods and techniques, admi istrative and court procedures, procedural due process, the legislative process, and public notice requirements. Excellent writing and editing skills Skill in conducting legal analysis and research Skill in using a computer for work-processing and data entry/retrieval Skill in handling multiple tasks, prioritizing, and meeting deadlines Skill in effective oral and written communication Skill in exercising sound judgment and effective decision making Ability to conduct administrative or appeals hearings; to interpret and apply laws; to prepare hearings decisions; to gather, assemble, correlate, and analyze facts; to write concisely; and to communicate effectively. Ability to conduct training and to provide guidance to others Ability to receive and respond positively to constructive feedback Ability to work cooperatively with others in a professional office environment Ability to provide excellent customer service Ability to work in person at assigned OAG work location, perform all assigned tasks at designated OAG work space within OAG work location, and perform in-person work with coworkers (e.g., collaborating, training, mentoring) for the entirety of every work week (unless on approved leave) Ability to arrange for personal transportation for business-related travel Ability to work more than 40 hours as needed and in compliance with the FLSA Ability to lift and relocate 30 lbs. Ability to travel (including overnight travel) up to 15% HEARINGS OFFICER IV All the functions for a HEARINGS OFFICER III, PLUS: One additional year working in victim services law or a closely related field Ability to coordinate administrative or appeals hearings, to conduct quality assurance reviews of hearings decisions, to develop policy and procedure manuals, and to supervise the work of others as needed PREFERRED QUALIFICATIONS Licensed as an attorney by the State of Texas and member in good standing with the State Bar of Texas Ability to proficiently read, write, and speak Spanish TO APPLY To apply for a job with the OAG, electronic applications can be submitted through CAPPS Recruit.
