Direct Care and Treatment (DCT) is seeking an individual to join our DCT General Counsel’s Office (GCO) for an exciting and rewarding opportunity as a Senior Associate General Counsel! This position will provide legal advice, counsel, direction, and supervision to the Minnesota Sex Offender Program (MSOP) executive team, management, and staff regarding pending, threatened, or potential civil, criminal and/or administrative legal actions. Specifically, you will serve as the primary legal counsel for MSOP and provide legal advice and direction on issues including, but not limited to, the Minnesota Commitment and Treatment Act; data privacy; protected health information; operations at DCT facilities; decisional capacity and due process relating to administration of neuroleptic medication and other treatment; criminal procedure; legal review of policies; management of litigation; consultation on and drafting of legislative proposals and Department rule making, and matters related to facility licensing.

Primary Responsibilities:

  • Provide legal advice and related services to DCT - MSOP executive and senior leadership, management, and staff and to other DCT divisions directed by supervisors in the GCO.

  • Provide legal advice and related services to MSOP executive and senior leadership, management, and staff regarding employment and labor law matters.

  • When requested by the supervisor of this position, provide legal advice to managers and executives on various topics within DCT, with a focus on civilly committed individuals and the operation of a state-operated sex offender civil commitment program.

  • When requested by the supervisor of this position, provide legal advice and related services to DCT executive and senior leadership, management, and staff and to Forensic Services.

  • Using knowledge of substantive law and policy, provide analysis, legislation drafting, and related writing to support Department of Human Services (DHS) legislative objectives, with particular emphasis on issues connected with civil commitment and MSOP.

  • Conduct legal review of DHS and DCT policies to ensure consistency with other DHS and DCT policies, applicable statutes, rules, regulations, licensing requirements, and regulatory standards. Develop and conduct trainings on legal policies.

Minimum Qualifications

JD degree from an ABA accredited law school;

Current license and in good standing to practice law in Minnesota;

Five (5) years’ experience as a practicing attorney in civil commitment, health care, privacy, or a related field. Experience must demonstrate the following:

  • Experience providing legal advice interpreting rules, laws, court orders and other legal and/or regulatory materials to senior management or executives.

  • Experience with the legislative process and federal and state laws.

Preferred Qualifications

  • Possess knowledge of state and federal law, rules, and regulations relating to the Minnesota Commitment and Treatment Act, the Minnesota Uniform Probate Code (specifically the Minnesota Guardianship Act), the Minnesota Health Records Act, the Minnesota Vulnerable Adults Act, the Minnesota Maltreatment of Minors Act, the Health Insurance Portability and Accountability Act, and the Minnesota Government Data Practices Act.

  • Experience identifying statutes and rules that apply to individual situations and experience advising decision-makers of the legal consequences for actions or failures to act in compliance with applicable statutes and rules.

  • Experience determining the impact of proposed or adopted changes in state or federal law, rule or regulation that impact DCT services, clients and staff.
